1. Scope of Application

These General Terms and Conditions (hereinafter referred to as “Terms”) apply to all services, offers, and contracts provided by JUMBMEDIA DESIGN STUDIO – FZCO, registered at:

Dubai Silicon Oasis, DDP, Building A1, Dubai, United Arab Emirates
– hereinafter referred to as “JumbMedia” – to its clients (hereinafter referred to as “Client”).

These Terms apply to all agreements regardless of the client’s location, unless mandatory local consumer protection laws stipulate otherwise.

2. Formation of Contract

Abinding contract is formed once the Client confirms a quotation from JumbMedia in writing or electronically (e.g., by email or by completing payment via Stripe or bank transfer). By accepting an offer, the Client agrees to the defined scope of services and to these Terms. These Terms shall form part of the contract if they have been provided or made accessible to the Client prior to contract conclusion.

3. Scope of Services

JumbMedia provides professional services in the following fields:

• Web Design & Development

• Branding & Identity Creation

• Search Engine Optimization (SEO)

• Social Media Marketing

• Content Production

• Marketing Automation

• Strategic Consulting

The exact scope of work is defined in the individual quotation or contract.
Any changes or extensions must be agreed upon in writing.

4. Satisfaction Guarantee

 

4.1 Scope 

JumbMedia offers a 100% satisfaction guarantee exclusively for web design services.
This guarantee includes free design revisions during the concept phase and up to 14 days after the website’s publication.

4.2 Exclusions

The satisfaction guarantee does not apply to:

• Services other than web design (e.g., SEO, social media marketing, copywriting)

• Functional or technical extensions (e.g., plugins, APIs, custom programming)

• Change requests made after the 14-day period

• Clients located outside the EU, Germany, Austria, or Switzerland

For clients outside these regions (e.g., in the United Arab Emirates), the satisfaction guarantee does not apply due to differing legal frameworks.

4.3 Payment Confirmation

Upon receipt of the first payment, the project is automatically confirmed, and the conditions of this satisfaction guarantee are accepted.

4.4 Maximum Amount and Refund Policy

The 100% satisfaction guarantee applies only to project values up to € 7,500  or 30.000 dirham (net).
For projects exceeding this amount, the following applies: If the final result does not meet the agreed expectations after reasonable revision rounds, the Client may request a refund of up to 25% of the total amount. If only a 50% advance payment has been made up to that point, an additional 25% invoice will be issued to cover invested work time.

In return, the Client receives full access to the website system and all deliverables produced up to that stage.

5. Client Responsibilities

The Client must provide all necessary information, materials, and approvals in a timely manner.
Delays caused by missing input or feedback entitle JumbMedia to adjust deadlines and charge for additional work as needed.

6. Payment Terms

Unless otherwise agreed, the following payment structure applies:

• 50% deposit at project commencement

• 50% balance upon completion and approval

Payments can be made via Stripe, credit card, or bank transfer.
Invoices are payable within 14 days of the invoice date.

All prices are net, exclusive of any applicable UAE VAT under current tax law.

In the event of late payment, JumbMedia reserves the right to apply late fees, interest, and to withhold delivery or activation of services.

7. Copyrights and Usage Rights

All creative works (designs, code, text, etc.) are protected under copyright law.
Usage rights are granted only after full payment has been received. Without explicit written consent, sharing, sublicensing, or modifying JumbMedia’s deliverables is prohibited.

8. Liability

JumbMedia shall only be liable for damages caused by gross negligence or intentional misconduct.
No liability shall be accepted for indirect or consequential losses, including lost profits, unless mandatory statutory provisions require otherwise.

9. Data Protection

Personal data is processed in accordance with the EU General Data Protection Regulation (GDPR) and the UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection, as applicable. Data is shared only for the fulfillment of contractual obligations or with the Client’s explicit consent. For full details, please refer to our Privacy Policy available on our website.

10. Governing Law and Jurisdiction

This agreement is governed primarily by the laws of the United Arab Emirates (UAE).

For clients based in the European Union (EU), Germany, Austria, or Switzerland, the following additional provisions apply:

• The Client remains subject to the consumer protection laws and enforcement mechanisms of their country of residence.

• Jurisdiction shall, where legally permissible, lie with the competent court at the Client’s place of residence.

• In cases of payment default or disputes arising from the contractual relationship, the law of the country in which the Client is domiciled shall apply.

The mandatory consumer protection provisions of the Client’s home country remain unaffected.

11. Final Provisions

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected.
In place of the invalid clause, a legally permissible regulation that most closely reflects the economic intent shall apply.
